These Terms of Use (“Terms”) govern your access to and use of the services, applications, portals and websites specific to the MyCabinet School Health Platform provided by MyCabinet, Inc. (collectively, the “Service”). The MyCabinet School Health Platform includes:
- The Nurse Portal – accessed by school nurses, school health staff, and other school-authorized personnel (“School Users”); and
- The Parent/Guardian App – accessed by parents, legal guardians, and, where applicable under FERPA, eligible students age 18 or older (“Parent Users”).
(together, the “Platform”) made available via web and/or mobile applications.
The Platform is operated by MyCabinet, Inc. (“MyCabinet,” “we,” “our,” “us”) and is provided to participating K–12 schools and school districts (“School” or “School District”) for the collection, management, and secure exchange of student health information.
Because this Platform processes student health information maintained by a school, all such records are considered “education records” governed by the Family Educational Rights and Privacy Act (“FERPA”). HIPAA does not apply to these records.
By accessing or using the Platform (or by having the Platform accessed on your behalf), you (“you” or “User”) agree to be bound by these Terms.
If you are using the Platform via a school, school district or other educational institution that has entered into a Master Service Agreement or other applicable Customer Agreement with MyCabinet (hereinafter referred to as the “Customer Agreement”), these Terms supplement that Customer Agreement. In the event of a conflict, the Customer Agreement will control.
1. Definitions
1.1 “Student Health Information” or “Student Data” means any data, content or information input into or maintained in the Platform relating to a student or minor’s physical or mental health, including health records, medication records, visit logs, screening reminders, outreach logs, documents, demographic or identifying information, and any derivative or metadata thereof, medication administration, allergies, immunizations, office visits, screenings, or other school health encounters that is maintained by the School or MyCabinet on the School’s behalf.
1.2 “Education Records” has the meaning provided under FERPA and includes Student Health Information maintained by a School or a party acting for the School.
1.3 “Parent/Gaurdian” or “Parent User” means a user who is a parent or legal guardian with FERPA rights to access a student’s records, and accesses the Parent App to view certain health/medication information, receive communications, or engage with the Platform on behalf of the student.
1.4 “Eligible Student” means a student who is 18 years or older or attending a postsecondary institution and who holds FERPA access rights.
1.5 “Authorized School Personnel” means school employees or contractors the School designates as having a “legitimate educational interest” to access Student Health Information.
1.6 “Authorized User” means a user permitted by a Customer to access the Platform (for example, a school nurse, parent/guardian, school administrative staff) in accordance with these Terms.
1.7 “Customer” means the school, school district or other organization that contracts with MyCabinet for the Service.
1.8 “Account Credentials” means the username, password or other authentication credentials provided to or created by an Authorized User or Parent/Guardian to access the Platform.
1.9 “Documentation” means any user manuals, training materials, guides or other written or electronic materials provided by MyCabinet describing the functionality of the Platform.
2.0 “Term” means the period during which you, your Customer organization and/or Authorized Users access the Service pursuant to the applicable agreement and these Terms.
2.1 “Site” means MyCabinet’s website(s), mobile applications and any related online presence of MyCabinet, Inc. (including but not limited to the Website at www.mycabinet.com and www.mycabinetschoolhealth.com).
2. Acceptance of Terms
By using or accessing the Platform (including via the Nurse Portal or Parent App), you confirm that:
- you are of legal age to form a binding contract on your own behalf or you are accessing the Service on behalf of a legal entity with authority to bind that entity;
- you have the authority to accept these Terms either personally or on behalf of the organization for which you are using the Service; and
- you have read, understood and agree to be bound by these Terms and any applicable Customer Agreement or license agreement you have entered into with MyCabinet (the “Customer Agreement”).
If you do not agree to these Terms, you must not use or access the Service.
3. Regulatory Compliance (FERPA; Not HIPAA)
3.1 FERPA Governs All Student Health Records
All Student Health Information stored, transmitted, or accessed through the Platform is considered Education Records under FERPA. These records are protected by federal law and applicable state student-privacy laws.
3.2 HIPAA Does Not Apply
Because Student Health Information is maintained by a School or by MyCabinet acting as a School’s agent, such data is expressly excluded from HIPAA.
3.3 MyCabinet Acts as a School Official
To the extent MyCabinet hosts, stores, or processes Student Health Information at the direction of a School, it does so as a “School Official” with a legitimate educational interest under FERPA.
4. Grant of Access and License
4.1 Subject to your compliance with these Terms and the Customer Agreement, MyCabinet grants you a limited, non-exclusive, non-transferable, non-sublicensable right (on behalf of the Customer organization) to access and use the Platform during the Term for the internal purpose of the Customer’s school-health activities.
4.2 You agree not to:
(a) license, sublicense, sell, lease, rent, transfer or time-share the Platform;
(b) reverse-engineer, decompile or disassemble any portion of the Platform;
(c) attempt to gain unauthorized access;
(d) use the Platform to build a competing service.
4.3 All rights, title and interest in and to the Platform (including software, underlying technology, Documentation, trademarks, and intellectual property rights) remain with MyCabinet and its licensors.
5. Roles, Responsibilities & User Accounts
5.1 You (or the Customer, as applicable) are responsible for:
- maintaining the confidentiality of your Account Credentials;
- promptly notifying MyCabinet of any unauthorized use or breach of security;
- ensuring that all Authorized Users comply with these Terms;
- ensuring accurate entry of Student Data and appropriate configuration of settings to meet your school-health operations.
5.2 School Responsibilities
The School is responsible for:
- Identifying Authorized School Personnel
- Ensuring that only those personnel access Student Health Information
- Ensuring parental notices and consents required under FERPA or state law
- Ensuring accurate and lawful data input
- Complying with all laws governing education and student data privacy
5.3 Parent/Guardian Responsibilities
Parents using the Parent App agree to:
- Only access or share Student Data for the student(s) for whom you are the rightful parent/guardian
- Keep login credentials confidential and safeguard your account access
- Maintain up-to-date contact and emergency information
- Use the Platform for lawful, school-related purposes only
5.4 Acceptable Use of the Platform
Users must:
- Protect devices used to access the Platform
- Notify the School or MyCabinet of any unauthorized access
- Use the Service in compliance with all applicable laws, regulations and policies, including without limitation FERPA, the Children’s Online Privacy Protection Act (COPPA) and relevant state student-data and health-data laws
Users may not:
- Share accounts or passwords
- Transfer, sell or lease access to the Platform
- Access or attempt to access records of students they are not authorized to view
- Introduce malware or attempt to interfere with, modify or disrupt the Platform or its security features
- Reverse engineer or manipulate the software
- Use the Platform to create or transmit spam, malicious code, or for data mining/scraping of unauthorized data
- Misuse Student Health Information or share it outside FERPA-permitted purposes
- Use the system in a manner that places an unreasonable load on the Platform or its infrastructure
- Use the Platform in any unlawful manner
MyCabinet may suspend or terminate access for violations.
6. Consent, Access Rights & Privacy Protections
6.1 FERPA-Required Parental Consent
By using the Parent App or providing information to the School for use in the Platform, Parents provide written consent to:
- The School’s creation and maintenance of Student Data in the Platform
- The sharing of such information between the School and MyCabinet
- Access by Authorized School Personnel for legitimate educational/health purposes
6.2 Access by Parents/Guardians.
The Platform allows Parent/Guardian access to view certain Student Data as permitted by the Customer organization. Parent/Guardian access is subject to the permissions set by the school nurse or district administrator.
6.3 Inspection & Review Rights
Parents and eligible students may:
- Request to inspect and review Student Health Information
- Request correction or amendment of inaccurate records
- Exercise any additional rights provided under FERPA
All such requests must be directed to the School, not MyCabinet.
6.4 Restrictions on Disclosure
The School may not disclose Student Health Information to third parties without parental consent except as permitted by FERPA (e.g., health/safety emergencies, other school officials with legitimate interest, legal orders).
MyCabinet will not disclose Student Health Information except:
- At the direction of the School
- As required by law
- To respond to a health or safety emergency under FERPA’s exception
6.5 Children’s Online Privacy Protection (COPPA)
The Platform is not intended for children under 13 to use directly.
The Parent App is designed for parents/guardians, not students.
MyCabinet does not knowingly collect information directly from children under 13.
7. Data Use, Storage, Security, and Retention
7.1 Student Data
MyCabinet acknowledges that Student Data may include education records (under FERPA) and/or protected health information (under HIPAA). Accordingly:
- MyCabinet and the Customer agree to treat Student Data in compliance with applicable laws (including, without limitation, FERPA, HIPAA, and any state equivalent).
- MyCabinet will act as a “processor” or “service provider” (as defined under the respective laws) to the Customer, who remains the “controller” or “covered entity,” unless otherwise specified in the Customer Agreement.
7.2 Data Use
MyCabinet processes Student Data only:
- To provide the Platform’s functionality
- To support the School’s student health-related operations
- To maintain and improve security, performance, and reliability
- As required by applicable law
MyCabinet does not use Student Data for advertising or commercial purposes.
7.3 Use and Disclosure of Personal Information/PHI.
Consistent with the Company’s Privacy Policy, the use, sharing and retention of personal information and PHI are subject to your consent, applicable law, and the Privacy Policy’s terms. The Privacy Policy states that MyCabinet does not sell personal information or PHI, and may use aggregated and de-identified data for business and analytic purposes.
7.4 De-Identified & Aggregated Data
MyCabinet may use de-identified or aggregated data for:
- Platform improvement
- Statistical reporting
- Analytics that do not identify individual students
All de-identification will follow FERPA standards.
7.5 International/Cross-border Transfers
MyCabinet may transfer data to, and store data in, jurisdictions outside your state or country, including the United States. By using the Service you consent to such cross-border transfers.
7.6 Third-Party Integrations
If the Platform integrates with third-party services (for example, electronic health record systems, school information systems, analytics providers), the Customer is responsible for ensuring those integrations meet the school’s consent, authorization and privacy requirements; MyCabinet is not responsible for the data practices of those third-party services unless explicitly specified in the Customer Agreement.
7.7 Security Measures
MyCabinet employs industry-standard administrative, technical, and physical security measures, including:
- Encryption in transit and at rest
- Role-based access controls
- Audit logs
- Secure hosting environments
- Data-minimization practices
No system can guarantee perfect security; however, MyCabinet’s safeguards are designed to meet or exceed FERPA requirements, and protect the confidentiality, integrity and availability of Student Data. MyCabinet commits to the security standards described in its Documentation, the Website, and the Customer Agreement
7.8 Data Retention and Deletion
- Student Health Information is retained only as long as required by the School.
- Upon a School’s request or termination of the Customer Agreement or these Terms, all Student Health Information will be securely returned or deleted.
- Parents seeking deletion must contact the School, which will direct MyCabinet appropriately.
8. Medical Disclaimer
The Platform:
- Does not provide medical diagnosis or clinical treatment
- Is not a substitute for professional medical care
- Is a tool for documentation, record-keeping, and communication within School health operations
Schools and their licensed personnel remain solely responsible for clinical judgments, treatment decisions, and emergency actions.
MYCABINET IS NOT A HEALTHCARE PROVIDER. MyCabinet does not engage in the practice of medicine. Our Services are offered for informational and communicative purposes only. The Services are not intended to be, and must not be taken to be, the practice of medicine, nursing, pharmacy or other healthcare advice by MyCabinet. Reliance on any information provided by MyCabinet or in connection with the Services or Platform is solely at your own risk. You are solely responsible for any decisions or actions you take based on the information and materials available through the Services or Platform.
WE ARE NOT LICENSED MEDICAL CARE PROVIDERS AND DO NOT ACT IN A HEALTH CARE PROFESSIONAL CAPACITY, NOR DO WE GUARANTEE THE ACCURACY OF ANY INFORMATION CONTAINED IN OR ACCESSED THROUGH THE SERVICES OR PLATFORM. BY USING THE PLATFORM, YOU ASSUME AND BEAR SOLE RESPONSIBILITY FOR (I) PROPER MEDICAL TREATMENT AND ADMINISTRATION OF MEDICATIONS, INCLUDING ALL DECISIONS TO SECURE PROPER TREATMENT FOR BOTH ROUTINE HEALTH CARE AND EMERGENCY SITUATIONS, AND (II) ANY MEDICAL OR MEDICATION ERRORS, MISTAKES OR INACCURACIES INCLUDING ANY BODILY INJURY, DEATH OR OTHER DAMAGES INCURRED AS A RESULT.
9. Service Availability & Modifications
MyCabinet aims for continuous availability but does not guarantee uninterrupted service. We may update, enhance, or modify features to improve performance or security. Schools will be notified of material changes affecting core functionality.
10. Security Incidents & Breach Notification
In the event of unauthorized access, acquisition, or disclosure of Student Health Information:
MyCabinet will:
- Promptly notify the School
- Provide information known at the time
- Cooperate with the School in meeting any legal notification or remediation obligations
The School remains responsible for parent/guardian notifications unless agreed otherwise.
11. Fees, Payment, Renewal & Suspension
11.1 Fees
Your access to the Platform may be subject to fees as set forth in the Customer Agreement. All fees paid are non-refundable unless otherwise agreed.
11.2 Renewal
Unless terminated as provided in the Customer Agreement, the Service will automatically renew for successive terms as set forth therein.
11.3 Suspension
MyCabinet reserves the right to suspend or restrict your access to the Platform immediately if: (a) you breach these Terms; (b) your Customer breaches the Customer Agreement; (c) you fail to pay any fees when due; or (d) MyCabinet reasonably suspects unauthorized or fraudulent use of the Platform.
12. Term and Termination
12.1 Term
These Terms remain in effect for as long as you use the Service or have an active Customer relationship with MyCabinet.
12.2 Termination by You
You may stop using the Platform at any time and, where applicable, terminate your access by providing notice as required in the Customer Agreement.
12.3 Termination by MyCabinet
MyCabinet may terminate your access and/or the Customer’s access (or deem the Customer Agreement terminated) immediately if: the School’s Agreement ends, you breach these Terms, the Customer fails to pay fees, or MyCabinet reasonably believes there is unauthorized use, data compromise or risk to the Platform.
12.4 Effect of Termination
On termination:
(a) User accounts will be disabled and you will cease all use of the Platform;
(b) MyCabinet may delete or destroy Student Data in its systems after providing the Customer the data to be returned as described in Section 7.8;
(c) all provisions which by their nature should survive termination (e.g., sections on intellectual property, limitation of liability, indemnification, confidentiality, data rights) will continue.
13. Intellectual Property
13.1 Ownership
MyCabinet retains all intellectual property rights in the Platform, software, design, logos, Documentation, and any modifications or derivative works thereof, except for Student Data and User-generated content, which remain owned by the Customer or Authorized User (as applicable). Schools and Parents receive only a limited, non-exclusive, non-transferable right to access and use the Platform as permitted under these Terms.
13.2 Feedback
If you provide feedback, suggestions or ideas for improvement of the Platform (“Feedback”), you assign to MyCabinet all rights in such Feedback, and MyCabinet may use, modify, or incorporate such Feedback without restriction or compensation to you.
14. Warranties; Disclaimers
14.1 Warranties
MyCabinet warrants that: (a) the Platform will perform materially in accordance with the Documentation; (b) MyCabinet will not intentionally degrade the Platform’s security without notice.
14.2 Disclaimers
Except for the limited warranty above, MyCabinet makes no other warranties, express or implied, regarding the Platform, including any implied warranties of merchantability, fitness for a particular purpose, availability or non-infringement. MyCabinet does not warrant that the Platform will be uninterrupted or error-free.
MyCabinet further disclaims liability for: (a) Decisions made by the School or its personnel; (b) Errors in data entered by Users; (c) Interruptions in service; (d) Losses caused by User negligence or misuse
14.3 Important Note for Parents/Guardians and Schools
The Platform is a tool to assist school health management and parent communication; it is not a substitute for professional medical advice or treatment. Schools, parents/guardians and nurses shall rely on their own professional judgment and consult appropriate health providers. MyCabinet disclaims any liability for health outcomes or treatment decisions made by Users based on data in the Platform.
15. Limitation of Liability & Indemnification
15.1 Limitation of Liability
To the maximum extent permitted by law, in no event will MyCabinet or its affiliates be liable for any indirect, incidental, special, punitive or consequential damages, or for lost profits or data loss arising out of or relating to your use of (or inability to use) the Platform, even if MyCabinet has been advised of the possibility of such damages.
15.2 Indemnification by You
You agree to indemnify, defend and hold harmless MyCabinet and its officers, directors, employees, agents and affiliates from and against any loss, cost, liability, damage or expense (including reasonable attorneys’ fees) arising from: (a) your unauthorized access or use of the Platform; (b) your breach of these Terms; (c) your violation of applicable laws; (d) your negligence, willful misconduct or misuse of Student Data.
15.3 Indemnification by the School
The School further agrees to indemnify, defend and hold harmless MyCabinet and its officers, directors, employees, agents and affiliates from and against any loss, cost, liability, damage or expense (including reasonable attorneys’ fees) arising from School’s: (a) unauthorized access or use of the Platform; (b) breach of these Terms; (c) violation of applicable laws caused by the School’s actions; (d) negligence, willful misconduct or misuse of Student Data by School personnel.
MyCabinet will indemnify the School for claims directly resulting from MyCabinet’s failure to comply with its data-security obligations
- Confidentiality
Each party agrees to hold the other party’s Confidential Information in strict confidence and not to disclose it to any third party except as permitted by the respective agreement (Customer Agreement or as required by law). “Confidential Information” means non-public information of a party disclosed in connection with the Service, marked or designated as confidential or reasonably understood to be confidential.
17. Governing Law; Dispute Resolution
17.1 Governing Law
These Terms are governed by the laws of the State of Florida without regard to its conflicts of law provisions.
17.2 Arbitration/Forum
Any dispute arising out of or relating to these Terms or the use of the Platform, which was not resolved (first) by good-faith negotiations, shall be resolved by binding arbitration in Broward County, Florida, under the rules of the American Arbitration Association (“AAA”), unless otherwise specified. You and MyCabinet each waive the right to a jury trial and to participate in a class action, to the extent permitted by law.
17.3 Injunctive Relief
Nothing in this Section 17 limits either party’s right to seek injunctive or equitable relief in court to prevent actual or threatened breach of confidentiality, intellectual property rights, or unauthorized use of the Platform.
18. Changes to Terms
MyCabinet may revise these Terms from time to time. We will provide notice of material changes by posting the revised Terms on our website or within the Platform and indicating the “Last updated” date. Your continued use of the Platform after the effective date of the changes constitutes your acceptance of the revised Terms. If you do not agree to any changes, you must stop using the Platform. Where required, renewed parental notice or consent may be requested by the School.
19. General Provisions
19.1 Entire Agreement
These Terms, together with the Customer Agreement (and any order forms, schedules or exhibits entered into between Customer and MyCabinet) constitute the entire agreement between you and MyCabinet regarding your access to and use of the Platform, and supersede all prior or contemporaneous agreements or proposals.
19.2 Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force and effect.
19.3 No Waiver
No failure or delay by MyCabinet in exercising any right under these Terms will operate as a waiver of that right.
19.4 Assignment
You may not assign your rights or delegate your obligations under these Terms without MyCabinet’s prior written consent. MyCabinet may assign these Terms in whole or in part to an affiliate or successor.
19.5 Notices
Notices to you may be provided by e-mail, through the Platform or by posting on our website. Notices to MyCabinet must be sent to:

19.6 Force Majeure
Neither party will be liable for delays or failures in performance due to causes beyond their reasonable control (e.g., natural disasters, acts of war, pandemic, government actions, telecommunications failure).
19.7 Export Laws
You will not export or re-export the Platform except in compliance with U.S. and other applicable export laws and regulations.
20. Additional Terms for Parent App Users
20.1 Parent/Guardian Access
If you are a Parent/Guardian using the Parent App, you understand and agree that: (a) your access is granted by the Customer (school/district) and subject to the permissions and policies they set; (b) you will only access information for the student(s) for whom you are the legal parent/guardian; (c) your usage must comply with these Terms and any additional policies provided by the school/district.
20.2 Communications
You consent to receive communications from MyCabinet (or via the Platform) via push notifications, e-mail or SMS, as further explained in our Privacy Policy. If you opt-out of certain communications, your use of some features may be limited.
20.3 Minors
If you allow a minor (under applicable age) to access the Parent App (for example to monitor their own health profile with parental permission), you must ensure proper supervision and compliance with applicable children’s data laws.
21. Additional Terms for Nurse Portal/School Users
21.1 Access
School nurses and other Authorized Users may use the Nurse Portal to track student visits, medication adherence, screening reminders, outreach logs, and other student health workflows, as described in the Quick Guide and Documentation.
21.2 Outreach Logging
When you contact parents/guardians and log outreach via the Platform, you must ensure such communications comply with the school’s communication policies, patient-privacy laws and parental consent obligations.
21.3 Workflow Accuracy
You acknowledge that the Platform assists but does not replace professional nurse judgment or school health protocols. You remain responsible for the accuracy and completeness of data entered and actions taken based on Platform workflows.
22. Website and Marketing Use
If you access MyCabinet’s Site (for marketing, information or trial access), you accept that your use may be subject to a separate Website Terms of Use or similar notice, but your access to the Platform is governed by these Terms.
